Customer Information / General Terms of Use

1. Basic Provisions

(1) These terms and conditions apply to all contracts you enter into with July Nutrition d.o.o. (referred to as “July Nutrition”) through the website
www.julynutrition.com. Unless otherwise agreed, we do not recognize external conditions imposed by customers.

(2) Definitions:

  • Consumer: any person entering into a contract for purposes mostly outside their business or profession.
  • Business Customer: any person or company acting for business or professional purposes when entering into a contract.

2. Conclusion of a Contract

(1) Contracts cover the sale of products.

(2) Product listings on our website are binding offers under the conditions described.

(3) Steps to place an order through the online shopping cart:

  • Add products to your shopping cart
  • Navigate to “One Step Checkout”
  • Make changes to your cart if necessary
  • Enter personal details, payment information, and choose a shipping method
  • Review order details
  • Click “Buy Now” to complete the purchase
  • If using instant payment (e.g., PayPal), you’ll be redirected to complete payment

(4) We send order confirmations and updates via email. Ensure your email address is valid and that our emails aren’t blocked by spam filters.

(5) Products are sold in quantities typical for personal use.

(6) We are not obligated to deliver if, after the order, circumstances beyond our control occur (e.g., discontinued products, strikes, force majeure). We are not liable for delays caused by such events.

(7) CBD-containing products are only sold and shipped to individuals aged 18 or over. By ordering, you confirm you meet this requirement.

3. Special Arrangements for Offered Payment Methods

Using direct debit requires a positive credit check. July Nutrition shares customer data with Klarna for address and credit checks during the purchasing process. Only payment methods suitable based on these checks are offered.

Note: Klarna is a third-party provider. Its terms and data handling practices are separate from those of July Nutrition.

4. Right of Retention & Reservation of Property Rights

(1) A right of retention applies only to claims arising from the same contractual relationship.

(2) Goods remain the property of July Nutrition until full payment is received.

(3) For commercial customers:

  1. Ownership remains with July Nutrition until all claims are settled. Pledging or assigning goods before ownership transfer is not permitted.
  2. Resale is permitted in the ordinary course of business. Claims from the resale must be assigned to July Nutrition. We accept this assignment. If payments are not properly fulfilled, we may collect the claim.
  3. If the goods are mixed with other items, joint ownership is established based on the relative value.
  4. July Nutrition will release securities upon request if their value exceeds the secured claims by more than 10%.

5. Warranty

(1) Statutory warranty rights apply.

(2) Consumers should check goods immediately upon delivery and notify us and the carrier of visible damage or discrepancies. This does not affect legal rights.

(3) For business customers, the following applies:

  1. Only our own and manufacturer’s product descriptions define the product characteristics.
  2. In case of defects, we may choose to repair or replace. If both attempts fail, the customer may request a price reduction or contract termination. We are not liable for added costs if goods are transported elsewhere, unless in line with intended use.
  3. Warranty period is 1 year after delivery, except for:
    • Damages due to injury to life, body, or health
    • Intentional or grossly negligent damage
    • Fraudulently concealed defects or guaranteed quality
    • Construction-related defects
    • Statutory recourse rights

6. Cancellation Policy for Consumers

You have the right to cancel your contract within 14 days without stating a reason.

The cancellation period begins:

  • From the day the goods are received (for standard orders)
  • From the day of first delivery (for recurring deliveries)

An informal notice (email or letter) is sufficient. You may use the sample form below. A cancellation is valid if sent within the 14-day period.

Consequences of Cancellation

  • We will reimburse returned goods within 14 days, excluding return shipping costs (unless goods were defective or incorrect).
  • Reimbursement is issued using the original payment method unless agreed otherwise.
  • We may withhold the refund until we receive the returned goods or proof of return.
  • Customers must return goods within 14 days after cancellation notice.
  • Customers bear return costs unless goods are incorrect or defective.
  • Customers are liable for diminished value due to improper handling.

Exclusion from cancellation:

  • Sealed goods unfit for return due to health/hygiene reasons, if unsealed
  • Goods mixed inseparably with others after delivery
  • Audio/video recordings or software if unsealed after delivery

7. General Instructions for Return

  • Please avoid damage or contamination of goods before returning.
  • Return goods in original packaging with all parts and accessories if possible.
  • Use protective packaging if the original is unavailable.
  • Do not send goods “carriage forward” — this may result in high fees.

The right to cancellation is not affected by this guidance.

8. Liability

We are liable for damages caused by intent or gross negligence by us or our agents.

We are also liable for slightly negligent breaches of essential duties necessary to fulfill the contract, but only for foreseeable damages.

These limitations do not apply to:

  • Injuries to life, body, or health
  • Defects after assumed guarantees
  • Fraudulently concealed defects

Liability under product liability law remains unaffected.

Where liability is excluded or limited, this also applies to our employees and agents.

9. Applicable Law, Jurisdiction, Final Provisions

  1. Slovenian law applies. For consumers, this applies only if their national protections are not reduced.
  2. For commercial customers, place of performance and jurisdiction is our registered office in Slovenia, unless otherwise required by law.
  3. The UN Convention on Contracts for the International Sale of Goods does not apply.
  4. We may change these Terms at any time. The version at the time of order applies unless legally required changes apply retroactively.
  5. If any clause is invalid, the remaining provisions remain in effect.

3. Contract Language and Retention

  • The contract language is English.
  • The full contract text is not stored. You can save or print it before placing your order.
  • Order confirmation and terms are sent by email after purchase.

4. Product Characteristics

Key characteristics are shown in each product listing.

5. Prices and Payment Methods

5.1. The total price includes the listed price(s) of the selected product(s) and any applicable shipping costs. All prices include statutory taxes unless otherwise indicated.

5.2. Shipping costs are not included in the product prices unless expressly stated (e.g., free shipping promotions). Applicable shipping fees are displayed during the checkout process and can also be found on the corresponding section of our website.

5.3. For deliveries outside the European Union, additional charges may apply, such as customs duties, import taxes, or banking transaction fees (including currency conversion fees). These are the responsibility of the customer. Even for deliveries within the EU, if payment is made from a non-EU bank account, the customer bears any bank-related charges.

5.4. We offer the following payment methods, which are processed securely via recognized payment service providers:

  • Mollie (payment gateway)
  • Klarna (including Pay Later, Pay Now, or installment options – subject to credit check)
  • Stripe (credit/debit card processing)
  • Apple Pay
  • Google Pay

5.5. Payment is due immediately upon conclusion of the contract, unless otherwise agreed or stated during the checkout process.

6. Delivery Conditions

6.1. Delivery conditions, estimated shipping times, and any applicable delivery limitations are displayed on product pages or during the checkout process.

6.2. For consumers, the risk of accidental loss or damage to the goods passes to the customer upon delivery. For commercial customers, the risk passes upon handover to the shipping provider.

6.3. Unless otherwise agreed, goods will be delivered to the address provided by the customer at checkout. Delivery and billing addresses may differ.

6.4. Shipping times stated on product pages are non-binding estimates unless explicitly stated as a guaranteed delivery date. In cases where ordered items are unavailable after purchase, the customer will be informed promptly. Statutory consumer rights remain unaffected.

6.5. If delivery fails due to the absence of the customer or an unauthorized recipient, the customer will bear the cost of return shipping and redelivery.

6.6. Personal pickup is not possible for organizational reasons. However, in exceptional cases, please contact us to explore alternative options.

6.7. If multiple products with different delivery dates are ordered, the shipment will be made in one parcel unless otherwise arranged. The longest delivery time will apply to the entire shipment.

6.8. Orders are shipped from our warehouse in Slovenia. The standard delivery time is 3–4 working days, unless otherwise stated.

8. Gift Cards

Gift cards are valid for 3 years from purchase. Use the voucher code at checkout. If the purchase value exceeds the voucher, the balance can be paid via other methods.

9. Data Protection

We process data in line with GDPR. See our Privacy Policy for details.

10. Online Dispute Resolution

The EU Commission offers a platform for online dispute resolution: https://ec.europa.eu/consumers/odr.
We do not participate in consumer arbitration proceedings.

Note: In case of discrepancies between translated versions of these Terms, the English version shall prevail.
